The petitioner has approached this Court for expeditious hearing of a case under NDPS Act being Case No. 52/2021 pending before the learned Judge, Special Court (NDPS) at Berhampore, Murshidabad. It is submitted on behalf of the petitioner that the petitioner was arrested on 11th March, 2021 with narcotic substance above commercial quantity and a case being Khargram Police Station Case No. 84/2021 dated 11th March, 2021 under Section 21(c) of the NDPS Act was registered against him. On 4th September, 2021 Police submitted charge-sheet against the accused. The learned Trial Judge took cognizance of offence on 6th September, 2021 and fixed several dates for framing of charge but till date the charge has not been framed.

At the outset, I like to record that trial of a case commences after framing of charge, when charge has not been framed by the

Trial Court against the accused, I am not in a position to pass any order with regard to expeditious disposal of the above-mentioned case. The instant petition being premature is dismissed. However, the petitioner is at liberty to pray for expeditious disposal of the case at an appropriate stage after commencement of trial. However, the learned Judge is requested to frame charge positively on the next date fixed.
