The petitioner is aggrieved that as a Physical Training Instructor of the Aliah University, he is not being given the emoluments as he is entitled as a "teacher". He is also aggrieved by the reduction of the Pay Scale made, in the corrigendum to the advertisement.

The petitioner's grievance had been reflected in the representations made, which have not been considered.

The petitioner will make a representation to the respondent no. 6 and/or any person authorized by him, not below the rank of Joint Secretary, by March 10, 2026, which will be considered and

disposed of by the respondent no. 6 upon giving a hearing to the petitioner, permitting him to rely upon all the documents and the decisions of the various courts including the Supreme Court of India. The representation, which will include the documents relied upon by the parties in this proceeding, will be made in the light of the decisions of the Hon'ble Supreme Court of India as well as the communication of the Government of West Bengal in the Memorandum No. 1075-MD11018/3/2024/MAME dated April 15, 2024. 4.

This representation will be disposed of by passing a reasoned order by April 15, 2026.

With the aforestated directions, the writ petition is disposed of.

I make it clear that I have not gone into the merits of the matter and all points are kept open to be decided by the respondent no. 6 or his authorized representative.

There shall, however, be no order as to costs. 8.
