REJECTED C.R.M.(A) 534 of 2024 In Re:- In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Beldanga Police Station Case No. 461 of 2023 dated 17.06.2023 under Section 376AB of the Indian Penal Code and Section 6 of Protection of Child From Sexual Offences Act, 2012.

And In Re : Sabkat Ali ...... petitioner Mr. Anisur Rahman ...for the petitioner Mr. Debasish Roy, Ld. P.P., ...for the State Affidavit of service filed be taken on record. None appears for the victim.

Materials in the case diary suggest the involvement of the petitioner in the incident. There is a statement recorded under Section 164 of the Cr.P.C. of the victim implicating the petitioner.

Petitioner approached the High Court earlier and allowed to such petition to be dismissed as not pressed. Thereafter the petitioner approached the Jurisdictional Court for grant of anticipatory bail, which was rejected. The present petition, however, does not allude to the fact that the petitioner

approached the High Court earlier and did not press the application for anticipatory bail.

In view of the materials in the case diary and the conduct of the petitioner, we are unable to grant anticipatory bail to the petitioner and the prayer for anticipatory bail is rejected. The application being CRM (A) 534 of 2024 is dismissed. (Debangsu Basak, J.) (Md. Shabbar Rashidi, J.)
