The father of the petitioner was an Assistant Teacher at Aboil Primary School, a school under Kumarganj Circle of Dakshin Dinajpur District Primary School Council who died-inharness on July 18, 2012. The petitioner being the dependent son of the deceased teacher, had applied for compassionate appointment as Teacher.

The Commissioner of School Education, Government of West Bengal, the respondent no.6 herein by the order dated May 30, 2019 has rejected the said prayer of the petitioner holding, inter alia, that the petitioner does not possess the requisite qualification for being appointed as an Assistant Teacher at a primary school.

The petitioner is now praying that his prayer for such appointment may be considered for Group-C or Group-D post. A representation of the petitioner to the said effect forms part of the writ petition being Annexure-P/4. The said representation is pending consideration before the Chairman of the Council, the respondent no.10 herein.

The said respondent is directed to consider the said representation in accordance with law as expeditiously as possible, preferably within a period of eight weeks from the date of communication of this order.

WPA 3648 of 2025 is disposed of without any order as to costs.

Since no affidavit has been invited, the allegations made in the writ petition are deemed to have been denied by the respondents.
