The allegation of the petitioners is that the final list of beneficiaries has not been properly prepared by the Hemtabad Gram Panchayat No. 4 in accordance with the relevant rules/guidelines/circulars of the Pradhan Mantri Awas Yojana Scheme.

The petitioners allege that a representation was made to the respondent authorities by letter dated 2nd February, 2021 but the same has not been taken into consideration till date.

The learned advocate appearing on behalf of the Union of India submits that the final list of beneficiaries annexed to the writ petition clearly shows that there are several irregularities.

It has been submitted that the maximum age limit for providing the benefits is 70 years but there are members who are more than the prescribed

maximum age limit incorporated in the said list. Apart from the above, it has been submitted, that there are several other irregularities.

None appears on behalf of the Panchayat despite service.

As it appears that the representation highlighting the irregularities at the time of preparation of the final list of beneficiaries is pending consideration at the end of the respondent authorities, no useful purpose will be served by keeping the writ petition pending.

The writ petition is accordingly disposed of by directing the respondent No. 5 being the Block Development Officer, Hemtabad to consider and dispose of the representation made by the petitioners on 02.02.2021, strictly in accordance with the relevant rules/guidelines/circulars at the earliest, but positively within a period of twelve weeks from the date of communication of a copy of this order. The aforesaid respondent shall pass a reasoned order and communicate the same to the petitioners, immediately thereafter.

It is made clear that this Court has not entered into the merits of the claim made by the petitioners and all points are left open to be decided by the aforesaid respondent at the time of consideration of the representation of the petitioner.

The petitioners are directed to forward a copy of the representation dated 02.02.2021 to the aforesaid respondent at the time of communicating the order of the Court.

The writ petition stands disposed of.
