This is an application praying for a direction upon the learned Civil Judge (Senior Division) at Alipore to dispose of the Title Execution Case No. 71 of 2023 expeditiously.

On a query of the Court the learned advocate appearing for the petitioner submits that no Misc. Case arising out of the said Title Execution Case is pending. She, however, submits that the judgment debtor has raised an objection as to the maintainability of the execution case.

It appears from the order dated December 12, 2024, that the petition dated April 19, 2024 was taken up for hearing on that date and the next date was fixed on January 24, 2025.

Learned advocate for the petitioner further submits that the hearing of the said petition was adjourned on January 24, 2025 and the next date has been fixed on March 21, 2025.

In the light of such submissions by the learned advocate for the petitioner, the learned Civil Judge (Senior Division), 3rd Court, Alipore, South 24 Parganas is requested to dispose of the petition dated April 19, expeditiously.

After disposal of the said application as well as any connected applications, the learned Civil Judge is requested to dispose of the Title Execution Case, as expeditiously as possible without granting any unnecessary adjournments to either of the parties.

C.O. 548 of 2025 stands disposed of accordingly. Urgent photostat certified copy of this order, if applied for, shall be furnished to the applicant at an early date, upon compliance of usual formalities. (HIRANMAY BHATTACHARYYA, J.)
