The State Mr. Narayan prasad Agrawala, Mr. Pratick Bose ... for the State Report submitted by the Learned Chief Judicial Magistrate, Tamluk, Purba Midnapore reflects that the appellant Pravat Chandra Bera expired on 24.10.2000.

Mr. Pratick Bose, learned advocate appears for the State. The appeal was preferred in the year 1989 almost 33 years have passed since the appeal was preferred in respect of judgment and order dated June 20, 1989 wherein the sentence imposed was till rising of the Court and fine of Rs. 1400/- in default to suffer simple imprisonment for one month passed by the Learned Special Court, Midnapore.

In view of the provisions of Section 394 of the Code of Criminal Procedure, I am of the opinion that the appeal has been abated. Accordingly, CRA 271 of 1989 is disposed of in terms of Section 394 of the Code of Criminal Procedure. All pending connected applications, if any, are consequently disposed of.

The department is directed to send back the lower court records.
