In view of the admitted possession of contraband articles seized from the petitioners are below the commercial quantity and the fact that charge-sheet has already been filed, we do not find any reason for further detention of the petitioners. Accordingly, we direct that the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/-(Rupees Ten Thousand only) each with two sureties of like amount each, one of whom shall be local, to the satisfaction of the learned Judge, Special Court, N.D.P.S. Act, Nadia, subject to the condition that they shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever and further subject to the condition laid down under Section 437(3) of the Code of Criminal Procedure.

In the event, they fail to appear before the trial court, the trial court shall be at liberty to cancel their bail in accordance with law without further reference to this court.
