This Court does not find any reason to interfere with the order impugned.

The learned Judge in-charge, 9th Bench, City Civil Court at Calcutta recalled an order dated February 16, 2023 by which the cross-examination of O.P.W.1 had been closed. The court was of the view that for the ends of justice one chance should be given for cross-examination of the O.P.W.1 before the argument commenced.

I do not find any illegality in the order impugned. The learned court is directed to dispose of the Misc. Case No.3940 of 2016 expeditiously, preferably within a period of three months from the next date fixed. The crossexamination shall be completed expeditiously. The learned court shall make all endeavour to dispose of the execution case along with all pending applications, expeditiously. Accordingly, the revisional application is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
