We have heard Mr. Kallol Guha Thakurata, learned counsel appearing for the appellant and Mr. K. K. Maiti, learned senior standing counsel for the respondent no.2.

The learned counsel for the appellant has produced a letter given by the Assistant Commissioner -I, Coal Mines Provident Fund, Regional Office, Kolkata dated 16th March, 2022. The contents of the letter is as follows:- "CPF/R.O/KOL/Legal/2021-22/980 Dated:16.03.2022.

To Kallol Guha Thakurta Senior Standing Council Advocate High Court Kolkata Sub: Cases retalted with service tax matter lying before this Hon'ble Calcutta High Court.ig.

Sir, The undersigned is directed to state that the cases/present appeals(s) pending before the Hon'ble Division Bench at Calcutta High Court be withdrawn at the earliest.

Kindly acknowledge the receipt of the letter and also intimate this office after withdrawing the cases/appeals as mentioned in the preceding paragraph.

The above letter is placed on record and the appellant is permitted to withdraw this appeal. Accordingly, the appeal and the connected application stand withdrawn. The Registry is directed to return the original certified copy of the impugned order to the appellant upon retaining a photostat copy thereof.
