Mr. Sagnik Mondal ... for the Petitioner(s) Mr. Bibaswan Bhttacharya Ms. Debarshi Brahma ... for the State-respondent(s) Mr. Mukherjee, learned Senior Advocate, appearing for the petitioner submits that the petitioner is in custody since 6th December, 2019 and only 10 witnesses till date have been examined out of the 61 witnesses cited in the charge-sheet.
Learned advocate for the State submits that inspite of efforts being exerted, trial could not be progressed because of non-cooperation and systematic delay. Be that as it may, having regard to the stage of the case; the offence committed and the fact that the prosecution has prayed before the court to examine five more witnesses being CSW 43(Md. Sahid); CSW 53 (Dr. M.W. Raja); CSW 55 (Dr. Biswanath Saren); CSW 57 (Md.
Zafar Parvej) and, CSW 58 (Parijat Chakraborty), five months' time is granted to the prosecution from the next date fixed.
It has been informed that the next date has been fixed on 24th April, 2026. The evidence of all these five witnesses should be completed by 24th September, 2026. The learned trial court would release the petitioner on bail after the evidence of the five witnesses is over. With the aforesaid observations, CRM(M) 475 of 2026 is disposed of.
