Mr. Monoranjan Jana .....For the Petitioners Mr. Lalit Mohan Mahata Mr. Ziaul Haque Mr. Prsanta Behari Mahata ....For the State The petitioners contend that they hold a decree affirming their right, title, and interest in Plot No. 3894 under J.L. No. 09, Mouza Kashinagar, Kakdwip, South 24 Parganas. They allege that Respondent No. 7, the owner of Plot No. 3897 of the same Mouza, has undertaken unauthorized construction that encroaches upon a portion of Plot No. 3894.

It appears that an application was submitted to the Pradhan of the concerned Gram Panchayat seeking information as to whether any permission had been granted by the Panchayat for the construction undertaken by Respondent No. 7. The petitioners state that no response has been received to their representation.

This Court is not in a position to adjudicate the allegations of encroachment.

However, liberty is granted to the petitioners to submit a fresh representation before the concerned Pradhan for redressal of their grievance. If such a representation is filed, the Pradhan shall consider and dispose of the same in accordance with law, after affording an opportunity of hearing to both the petitioners and Respondent No. 7. This exercise shall be completed within one month from the date of submission of the representation.

Accordingly, WPA 3668 of 2025 is disposed of.
