It is submitted on behalf of the petitioners the agreement for sale relied upon by the de-facto complainant is forged. Petitioners have lodged a case against the de-facto complainant. In the said case, expert's report shows petitioners' signatures in the said agreement are forged. Accordingly, they pray for anticipatory bail. 3.

Learned Advocate for the State opposes the prayer for anticipatory bail.

We have considered the materials on record. An agreement for sale of land is said to have been entered by and between the parties. While in the present case de-facto complainant contends his signature was forged and petitioners had misappropriated money advanced to them, it is the contention of the petitioners that their signatures on the agreement are fake. Petitioners have lodged another case. Expert's

report corroborates the stance of the petitioners that their signatures are forged. Investigation in the case revolves around the agreement which is in control and custody of the Investigating Agency. 5.

Under such circumstances, we are of the opinion though custodial interrogation of the petitioners is not necessary, they require to cooperate with investigation in accordance with law. 6.

Accordingly, we direct in the event of arrest, the petitioners, namely, (1) Suprotim Mukherjee & (2) Nivedita Mukherjee, be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only) each, with two sureties of like amount each, to the satisfaction of the arresting officer and also subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and on further condition that petitioner no.1 shall meet the Investigating Officer once in a week until further orders. They shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
