Affidavit of service filed by the petitioners is taken on record.

None appears for the Panchayat despite service. Learned counsel for the petitioners submits that the predecessor in interest of the petitioners late Taran Bagdi was employed as a Gram Panchayat Karmee by virtue of an appointment letter issued on January 6, 1999. He exercised option under the West Bengal Service Rules (ROPA), 2019 and his scale of pay was accordingly fixed by the 6th respondent on January 24, 2020. The wife of Taran Bagdi pre-deceased him. Taran Bagdi died in harness on August 12, 2024 leaving behind the petitioners as his heirs.

The petitioners submitted an application before the concerned authority seeking disbursal of the service benefits of their predecessor pursuant to which the Block Development Officer, Labpur Development Block forwarded

the application to the Financial Controller and Chief Accounts Officer, Birbhum Zilla Parishad on 24th June, 2025. The application is yet to be considered. In view of the above, Financial Controller and Chief Accounts Officer, Birbhum Zilla Parishad, being the 5th respondent herein is directed to consider and dispose of the application submitted by the petitioners within four weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned including the petitioners, in accordance with law.

The decision taken by the authority shall be communicated to the petitioners within a week thereof. In the event the concerned authority arrives at the conclusion in favour of the petitioners, necessary consequential steps be taken at the earliest. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
