The present writ petition is restricted to the apprehension of the petitioner in view of the earlier incidents that he will not be able to depose before the Court in connection with S.T. Case No. 01(03) of 2022 arising out of New Alipore Police Station Case no. 244 of 2018 pending before the learned Additional District & Sessions Judge, Fast Track 7th Court at Alipore. In view of the apprehension expressed by the petitioner and the experiences as the petitioner has revealed, I am of the view that some interference is required.

Although, learned advocate appearing for the State has submitted a report which reflects that the present petitioner did not inform the jurisdictional police station being Manicktala Police Station.

Be that as it may since a sessions triable case is in progress before the learned Additional District & Sessions Judge, Fast Track 7th Court at Alipore, I direct that if the petitioner takes out any application before the learned trial Court under the relevant provisions of the Witness Protection Scheme, 2018, learned trial Court will call for a Threat Perception Report assess the same and thereafter pass necessary direction upon the concerned authorities by providing protection to the petitioner. In case such an application is filed the learned Magistrate would put in efforts so that the same is disposed of within a period of three weeks.

With the aforesaid observations WPA 3631 of 2024 is disposed of.

The three reports submitted by the State be kept with the record.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
