Advocate for the petitioners has not filled up the e-mentioning link sent to him for joining the proceeding on virtual mode to conduct the hearing of the matter.

The respondents no.2 and 3 are represented. The said respondents say that the petitioners are seeking election of the cooperative society, being the fourth respondent in the writ petition. The respondents no.2 and 3 do not have any objection in holding the election after 2nd May, 2021 on completion of the General Assembly Election in the State of West Bengal.

Considering the prayer in the writ petition and the submission of the respondents no.2 and 3, it appears that justice will be sub-served if the respondents no.2 and 3 are directed to take necessary steps to hold the election for the fourth respondent society by complying with the

provisions of the West Bengal Co-operative Societies Act, 2006 and the rules framed thereunder.

The entire election process should be completed within 15th June, 2021.

It is made clear that the respondents no.2 and 3 shall, at every stage, comply with the provisions of the West Bengal Co-operative Societies Act, 2006 and the rules framed thereunder required to be complied with for holding election of a cooperative society like that of the respondent no.4.

The petitioners, the respondents no.1, 4, 5 and 6 and all other members of the respondent no.4 society shall render full cooperation to the respondents no.2 and 3 for holding the election as the same will enure to their benefit. Nothing further remains to be adjudicated in this writ petition. The same is disposed of accordingly without any order as to costs.

Since I have not called for any affidavits, allegations made in the writ petition are deemed to have not been admitted.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
