Petitioner has filed the present writ petition alleging unauthorized construction on R.S. Dag No.3063 corresponding to R.S. Khatian No.863 lying within Mouza - Barhans Fartabad, comprised in J.L. No.47 within the limits of Ward No.29 of Rajpur Sonarpur Municipality, P.S. Narendrapur, Dist. South 24Parganas. 2.

It is the case of the petitioner that unauthorized construction is being carried out by one Smt. Moumita Bera Ghosh, respondent no.7 herein. Petitioner had made a representation before the Rajpur Sonarpur Municipality on 25.01.2025. The same has not been acted upon nor any action has been taken.

Learned Advocate for the respondent-Municipality submits that they are ready and willing to decide the petitioner's representation dated 25.01.2025.

In view of the submission made by the learned Advocate for the respondent-Municipality, petitioner submits his grievance will be satisfied if the representation is decided in a time bound manner.

Accordingly, this Court directs the respondent-Rajpur Sonarpur Municipality to decide the representation of the petitioner dated 25.01.2025 within a period of eight weeks from the date of communication of this order after affording an opportunity of personal hearing to the petitioner as well as the private respondent no. 7.

With the aforesaid directions, the present writ petition is disposed of.

There shall be no order as to costs.
