C.R.M. (NDPS) 228 OF 2025 + CRAN 1 of 2025 In Re : An application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 in connection with N 19 of 2022 arising out of NCB Crime No. 06/NCB/Kol/2022 under Section 8(c) read with 21(c)/20(b) (ii) (B)/25/28/29/54 of the NDPS Act.

And In the matter of : Krishnapada Paul .... Petitioner Mr. Angshuman Chakraborty, Mr. S. S. Saha .... For the petitioner Mr. Himangshu De, ... for NCB The petitioner has prayed for relaxation of the condition of bail order which was imposed by this Court vide order dated 17th March, 2025, by which petitioner was directed to remain within the jurisdiction of Barasat Police Station and also to report to the Officer-in-Charge of Barasat Police Station once in a week until further order.

Learned counsel appearing on behalf of the petitioner submits that petitioner is suffering from Tuberculosis and he needs better treatment from a reputed hospital in Kolkata and as such he needs to move beyond the jurisdiction of Barasat Police Station.

He further submits that he is presently residing within Bagda P.S. area and he is facing inconvenience to meet the Officer-in-Charge, Barast Police Station once in a week. Having heard the learned counsel appearing on behalf of the petitioner and the learned counsel appearing on behalf of the NCB, the condition imposed in the order dated 17th march, 2025 is modified to the extent that the petitioner shall remain within the jurisdiction of geographical limit of North - 24 Parganas District and Kolkata district and that he will report the Officerin-Charge Bagda Police Station once in a month till further order.

The order dated 17.03.2025 is modified to that extent only, other portions of the order shall remain unaltered. CRAN 1 of 2025 stands disposed of.

Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities.
