The learned counsel for the appellant submits that during the pendency of this proceeding the Title Suit No.1776 of 2019 was dismissed for default on October 17, 2023 and has not yet been restored.

However, it appears that the defect has not been removed. Hence, the appeal stands dismissed for nonremoval of defects and also the appeal is barred by limitation.

Accordingly, the appeal and the connected application are dismissed.
