The fact of the case reveals that five liters of codeine mixture is recovered from the possession of the present petitioner, which is above commercial quantity. As the provisions of Section 37 of the NDPS Act is attracted, we are not inclined to release the petitioner on bail although, the petitioner is in custody since 8th April, 2020.

Accordingly, the prayer for bail is rejected. All parties shall act on the server copy of the order. (Tirthankar Ghosh, J.) (Soumen Sen, J.)
