Petitioners complain that the police authorities have not acted promptly in connection with Khatra P.S.

Case No.91 of dated 31.12.2024 and in spite of informing the police authorities repeatedly, no steps have been taken in course of the investigation. Additionally, it has been submitted that the superior officers of the police were also informed. However, the same did not yield any result and the petitioners till date are feeling insecured because of the overtacts of the private respondents.

Mr. Datta, learned advocate appearing for the State has already submitted a report. Report reflects that already statement of the victim has been recorded and she was also referred to the learned

Judicial Magistrate wherein statement has been recorded under Section 183 of the BNSS. Steps have been also taken pursuant to the directions passed by the learned Executive Magistrate.

There has been previous dispute as is revealed from the report of the police authorities. However, having regard to the nature of the case which has been registered, I am of the view that the police authorities will take the investigation of the case to its logical conclusion. In case the petitioner no.1 apprehends that she is feeling insecured, an appropriate application under the Witnesses Protection Scheme, 2018 be filed before the learned Magistrate already in seisin of the matter. Learned Magistrate will assess the situation after calling for a report from the concerned police authorities.

Necessary directions be passed by the learned Magistrate after the same.

With the aforesaid observations, WPA 3698 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioners.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
