C.R.R. 347 of 2021 Court No.

Item 23 ssi In the matter of:- Debabrata Datta @ Debabrata Dutta & anr. 10.02.

Mr. Ansuman Bera ...for the petitioners Mr. Imran Ali Mr. Md. Kutubuddin ...for the State This is an application seeking expeditious disposal of a proceeding in which a charge-sheet was submitted under Sections 406 and 498A of the Indian Penal Code. Let a copy of the application be served upon Mr. Imran Ali and Mr. Md. Kutubuddin, learned advocates, who are present in court today and who ordinarily appear on behalf of the State. Their engagement may be regularised in due course by the competent authority of the State.

Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the accused in this case. Although the First Information Report was registered in 2016 and charges were framed in 2017, till date, the impugned proceeding could not be concluded. Out of 9 witnesses, only 4 witnesses have been examined. However, after December 2019, there was no examination of any witness. The proceeding has remained pending for no fault of the present petitioners. Learned counsel appearing on behalf of the State, in

his usual fairness, submits that it would be in the interest of justice that the impugned proceeding is expedited. I have heard the submissions of the learned counsels appearing on behalf of the petitioners and the State and have perused the revision petition. No prejudice will be caused to any one, if a direction is passed to expedite the proceeding.

It appears that some delay has been occasioned in concluding the impugned proceeding, especially after December, 2019.

In view of the above and in the interest of justice, I request the learned trial Court to conclude the proceeding as expeditiously as possibly without granting any unnecessary adjournment to any of the parties, preferably within a period of eight months from the next date of hearing.

With these observations, the revisional application is disposed of.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
