Kamala Halder -vs- State of West Bengal Mr. Abhijit Singh Ms. Sarmistha Basak ... for the petitioner This is an application wherein petitioner has prayed for a direction for expeditious disposal of the proceedings in connection with ACGR 5444/2023 presently pending before learned Additional Chief Judicial Magistrate, Alipore. It is submitted on behalf of the petitioner that the complainant preferred an application under section 439(2) Cr.P.C. before the learned District and Sessions Judge, Alipore and the said court rejected the said petition on 24.04.2025 and since then the case record is lying with the District Judge and the hearing of the case get stalled. Therefore, the petitioner has prayed for a necessary direction.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and, if it is allowed in terms of the prayer made in the petition, the opposite party will have no cause to prejudice and as such, service of copy of application upon the opposite party is dispensed with. Having heard learned counsel for the petitioner and that the prayer made on behalf of the petitioner is justified the instant application being CRR 737 of 2026 is hereby disposed of with a direction upon the District and Sessions Judge, (South) 24 Parganas, to return the case record within fortnight from the date

of communication of this order and the trial court after receipt of the record shall conclude the charge hearing within a period of one month thereafter.
