Petitioners allege that the Election Commission has not disposed of the complaint lodged by the petitioners pursuant to the liberty granted by a coordinate Bench by order dated November 21, 2025 in WPA 26516 of 2025.

Mr. Nayak, learned advocate appearing for the Cooperative Election Commission, being the 2nd respondent, submits that the election has already been held and the Board has been constituted. He further submits that no document has been disclosed by the petitioners in this writ petition to show that

the complaint dated November 25, 2025 has been served upon the West Bengal Cooperative Election Commission.

In reply, learned advocate appearing for the petitioners submits that the said complaint has been served upon the Cooperative Election Commissioner. Without entering into the controversy as to whether the complaint dated November 25, 2025 was served upon the authority or not, at this stage, this Court directs the petitioners to appear at the office of the Cooperative Election Commissioner within two weeks from the date of receipt of a server copy of this order along with a copy of the complaint dated November 11, 2025 and the documents in support of the petitioners' contention that such complaint has been served upon the Cooperative Election Commissioner.

If such an approach is made by the petitioners along with the documents as observed hereinbefore, the Cooperative Election Commissioner shall consider the complaint dated November 25, 2025 and dispose of the same in accordance with law as expeditiously as possible but positively within a period of four weeks from the date of approach by the petitioners along with the documents as indicated hereinbefore.

With the above observations and directions, this writ petition stands disposed of.

It is, however, made clear that this Court has not entered into the merits of the complaint made by the petitioners and all points are kept open to be decided by the appropriate authority in accordance with law.
