This is a writ application for transfer of the petitioner from one school to another. His application has been returned by the District Inspector of Schools (S.E.). The DI has returned it on the ground of more than 10% teachers have been transferred from the school. The petitioner raises objection to that.

In such situation, I direct the concerned District Inspector of Schools to take a decision in this regard by taking a re-look at the matter after giving an opportunity of hearing to the petitioner within a period of four weeks from the date of communication of this order. If it is found that the petitioner is eligible to transfer and the DI

has made some mistakes of facts the DI will recommend the petitioner for transfer to the next authority within a period of two weeks after the expiry of said four weeks if it is to be forwarded at all. Otherwise the DI will intimate the petitioner in writing as to his decision. Despite service nobody has appeared for the State. The petitioner is directed to serve a copy of this order upon the learned advocate for the State, who has been engaged in this matter and the said learned advocate will communicate this order to the District Inspector of Schools.

With the above observation and direction, this writ application is disposed of.
