Yusuf Ali ...for the State Mr. Kanak Kiran Bandyopadhyay ,,,for the WBCSSC In terms of the order dated 7th April, 2025 District Inspector of Schools (SE) Dakshin Dinajpur being respondent no. 5 has filed a report dated 24th April, 2025 enclosing staff pattern of the school and class routine of the petitioner and same is taken on record.

On perusal of the report it appears that petitioner is a teacher of Pure Science in the school in question having educational qualification B.Sc.(Pass) and another teacher namely Najmul Hossain Mandal joined the post of assistant teacher in Science Group in the same school. In view of appointment of said Najmul Hossain Mandal petitioner is not to be considered as a single teacher in the subject in the school. Therefore, his application for transfer on general

ground (distance) now needs to be considered in accordance with law.

In spite of service of notice school authority is not represented today.

Authorities of Badamail L.P. High School (HS), Dakshin Dinajpur being respondent nos. 7, 8 and 9 are directed to issue 'no objection' in favour of the petitioner for his transfer by 7 (seven) days from the date of communication of this order and transfer application to be forwarded by the said school authority by 7 (seven) days thereafter to respondent no. 5. On receipt of transfer application along with no objection respondent no. 5 shall process the same and forward it manually to the Chairman, West Bengal Central School Service Commission being respondent no. 3 by fortnight thereafter. On receipt of transfer application and relevant documents respondent no. 3 shall decide the transfer application by 6 (six) weeks thereafter and decision to be communicated to the petitioner by fortnight thereafter.

It is made clear that suspension of portal shall not be ground to reject the transfer application of the petitioner.

Writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
