ct. no. 34 CRR 172 of 2015 Samir Kumar Dey @ Samir Dey @ Kanai Vs.

State of West Bengal & Anr.

Mr. Arijit Ganguly, Mr. Sanjib Kr. Dan ... for the State.

The revisional application has been preferred challenging the continuance of Samuktala Police Station Case no.173 dated November 25, 2007. The revisional application was preferred immediately after the charge sheet was filed before the jurisdictional Court.

Records reflect that the revisional application appeared on January 29, 2015 when this Court was pleased to grant an interim order for a period of six weeks. Thereafter, there was no extension of the interim order and there has been no persuasion on behalf of the petitioner before this Court. Records further reflect that the only documents which have been enclosed along with the revisional application are the charge sheet and the FIR and none of the documents under Section 207 of the Code of Criminal Procedure have been relied upon by the petitioner.

None appears on behalf of the State, Mr. Arijit Ganguly, learned advocate, who ordinarily appears for the State, is directed

to appear in this matter and represent the State. His appointment may be regularized by the concerned authority. In view of the observation made above, I am of the opinion that the revisional application was premature and the issues which have been raised are question of facts. Thus, no interference is called for.

Accordingly, CRR 172 of 2015 is dismissed.

All pending connected applications, if any, are consequently disposed of.

Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Tirthankar Ghosh, J.)
