Mr. Anjan Banerjee ...for the petitioner Mr. Pantu Deb Roy, Mr. Pannalal Bandopadhyay ...for the State The innocuous submission of the petitioner is that the petitioner is being allegedly obstructed by the private respondent from plying his vehicle on the concerned route despite having a valid permit for so plying.

Upon hearing learned counsel for the petitioner there appears to be substance in the contention of the petitioner. However, even without going into the merits of the allegations made by the petitioner against the private respondent, W.P.A. No. 4283 of 2021 is disposed of by directing the respondent-authorities to consider and decide on the present writ petition, treating the same as the representation of the petitioner with regard to the alleged obstruction being faced by the petitioner in plying his vehicle on an authorised route, as expeditiously as possible, and to take all necessary steps upon such

decision at the earliest thereafter to ensure smooth plying of the vehicle by the petitioner.

It is expected that the respondent-authorities shall give a right of hearing to the petitioner and decide the issue as expeditiously as possible, preferably within four weeks from date and take consequential measures in accordance with law immediately thereafter.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
