The learned Counsel for the petitioner has submitted that the petitioner stands on the same footing as Samim Sk. who was granted bail on 25th January, 2021 by a coordinate Bench.

The learned Counsel for the State opposes the prayer for bail. Having regard to the fact that the present petitioner is standing on the same footing as Samim Sk. who was granted bail, we are of the opinion that the present petitioner is entitled to statutory bail.

Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-(Rupees Ten Thousand only) with two sureties of like amount each, one of whom shall be local, to the satisfaction of the learned Judge, Special 3rd Court, Malda under the N.D.P.S. Act, subject to condition that the petitioner shall not leave the jurisdiction of Baishnabnagar Police Station without the leave of the trial court and shall attend the trial court on every date of hearing. The prayer for bail of the petitioner is allowed. CRM 1635 of 2021 is accordingly, disposed of. All parties shall act on the server copy of the order. (Tirthankar Ghosh, J.) (Soumen Sen, J.)
