No.39 CRR 637 of 2022 In the matter of : Golam Odud Mollah Mr. Anshuman Chakraborty Mr. Shashanka Shekhar Saha ... for the petitioner Mr. Debabroto Chatterjee Mr. Nirupam Dhali .... for the State This is an application seeking an expeditious disposal of a proceeding on which charge sheet was submitted under sections 21( C ) of the Narcotic Drugs and Psychotropic Substances Act Mr. Debabroto Chatterjee and Mr. Nirupam dhali, learned counsels present in Court today who ordinarily appear on behalf of the State are requested to appear in this matter. Their engagement may be regularised by the competent authority of the State in due course. A copy of the application be served upon them. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner was arrested on 18.08.2020.

Charge sheet was submitted in October, and a supplementary chare sheet was submitted in December, 2020. The prosecution proposes to examine nine witnesses in this case. On 20.11.2021 a charge was framed. Thereafter, not yet a single witness was examined. Long dates are being fixed. The proceeding has remained pending for no fault on the part of the present petitioner.

Learned counsel appearing on behalf of the State submits that the State would not come in the way if a direction is passed for an expeditious disposal of the proceeding.

I have heard the submissions of the learned counsels appearing for the petitioner, State and have perused the revision petition.

It appears that some delay has been occasioned in concluding the proceeding, especially considering the fact that the petitioner is in custody since 18.08.2020.

In view of the above and in the interest of justice, the learned Trial Court is requested to conclude the trial as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of one year from the next date of hearing.

With these observations, the revisional application is disposed of.
