Mr. Kaushik Ghosh, Mr. A. Chakraborty ...for the petitioner Ms. Faria Hossain, Ms. Snigdha Saha ...for the State Affidavit-of-service filed by the petitioners is taken on record. Report submitted by the Inspector-in-Charge, Kalna Police Station dated 05.03.2025 is also taken on record.

In this application, the petitioners have prayed for expeditious disposal of T.R. Case No.476 of 2024 presently pending before learned Judicial Magistrate, 2nd Court, Kalna.

Being aggrieved by the delay caused in disposal of the instant proceeding, learned Counsel for the petitioners submits that the proceeding under Sections 498A/323 of the Indian Penal Code was initiated against the petitioners on 1st August, 2021. Thereafter the Investigating Agency submitted charge-sheet after completion of investigation on 12.10.2021 and the Court below framed charge against the petitioners on 05.10.2023. The police report shows that so far two witnesses have been examined out of 8 charge-sheeted witnesses. It is alleged by the petitioners that the matter got repeatedly adjourned for no fault of the petitioners but because the witnesses did not turn up. Accordingly he prayed for a direction upon the Court below for

preponement of the next date which is fixed on 11th August, 2026 and for a further direction to conclude the trial within a reasonable period. Having heard learned Counsel for the petitioners and the opposite party/State, I find that the prayer made by the petitioners is innocuous and required to be allowed for securing the ends of justice. In view of above, the instant application being CRR 739 of 2026 is hereby disposed of with a direction upon the Court below to prepone the next date of trial and to re-fix any date in the Month of May, 2026 and thereafter he will fix at least two dates within a month and will make his best endeavour to conclude the trial within a period of six months thereafter.

This order is passed invoking this Court's jurisdiction under Section 529 of the BNSS.
