The United Bank of India has been merged with the Punjab National Bank. The name of the respondent no. 1 shall stand corrected to read as Punjab National Bank.

The name of the United Bank of India in the respondent nos. 2 and 3 shall also stand deleted and corrected as Punjab National Bank.

Leave is granted to the petitioner to amend the cause title by tomorrow (04.01.2024).

The petitioner claims that he has been appointed as "Badli Sweeper" in the Bhimpur Branch of the said bank. His services were terminated after 5 years for various acts and omissions.

Counsel for the petitioner would argue before this court that there is stigma attached to the order of termination. Such stigma would
warrant a proper departmental enquiry and/or compliance of the principles of natural justice.

This Court has noted that the petitioner's appointment is casual and/or temporary.
There appears to be no procedure followed in the petitioner's appointment, i.e., advertisement, notice to employment exchanges, age, qualification and other matters. These are the normal procedures of recruitment by any authority or State, recognized in law.

Since the petitioner's appointment cannot be accepted as regular, the question of any right arising out of any engagement of the petitioner by the bank therefore does not and cannot arise.

In those circumstances, no relief can be granted to the petitioner in the writ petition. Hence, WPA 2765 of 2020 shall stand dismissed.

There shall be no order as to costs.

Urgent photostat certified copy of this judgment, if applied for, be given to the parties upon compliance of all formalities.
