The petitioner has approached this Court for a direction upon the learned Metropolitan Magistrate, 5th Court at Calcutta for expeditious hearing of Case No. CN/829/2020 pending before his Court.

It is submitted by the learned Advocate for the petitioner that the aforesaid case was filed under Section 138 of the Negotiable Instruments Act in the year 2020. Till date the accused has not been examined under Section 251 of the Code of Criminal Procedure. It is submitted by the learned Advocate for the petitioner that on the prayer of the accused persons one after another date is fixed for examination of the accused under Section 251 of the Code of Criminal Procedure.

Under such circumstances, the instant revision is disposed of directing the Trial Court to examine the accused person under Section 251 of the Code of Criminal Procedure within one month from the date of this order. Thereafter, he shall proceed to examine the witnesses and complete the recording of evidence within six months. With the above direction, the instant revision is disposed of. (Bibek Chaudhuri, J.)
