2022-02-24Hon'Ble Justice Abhijit Gangopadhyay3 pages

24. 02. 2022 BP Sl. 70 Court No. 17 WPA 2772 of 2020 (Via Video Conference) Ruma Roy Vs.

The State of West Bengal & Ors.

Mr. Ekramul Bari Ms. Tanuja Basak Sk. Imtiaj Uddin ..for the petitioner.

Mr. B.P. Vaisya Mr. Pinaki Bhattacharya ..for the State.

Mr. R.N. Chakraborty Mr. M. Ahmed ..for the Secretary of the School.

After the order passed by this court on 17.02.2022, no objection has been granted to the petitioner by the school. The school is directed to upload it through Utsoshree portal so that it can be seen through Utsoshree portal that the petitioner has got no objection from the school.

Learned advocate for the Secretary of the school, who is the sub-inspector of school, has submitted that it has already been uploaded on 19th February, 2022. There is no other thing to be adjudicated in this matter. This court expresses its serious displeasure in

not granting the no objection certificate to the petitioner. A copy of this order should be sent to the District Magistrate of Birbhum and the Principal Secretary of Education Department so that they come to learn that how the court's general order for granting no objection is being flouted. If this is the state of affairs in this State the court will not hesitate to pass harsh order on the persons who would not comply with the general order of granting no objection to the teachers.

With the above observation, this writ application is disposed of.

The personal appearance of the secretary of the school, who is also the sub-inspector of school, is dispensed with.
