For the State The petitioner is directed to serve a copy of this revisional application upon Mr. Sanjib Kumar Dan, Learned Advocate, who ordinarily appears on behalf of the State. His appearance may be regularised by the concerned authority. The petitioner is aggrieved by the fact of delay in the trial. Charge was framed on 27th of April, 2022 but till date none of the witnesses have been examined.

Learned Advocate submits that there are five witnesses in support of the prosecution's case. In view of the frustration so expressed by the accused persons because of the agony of the criminal trial, which arose out of matrimonial discord, I direct the ld. Trial Court to fix at least one date in every sixty days so that the

trial of the case can be taken to its logical conclusion within a reasonable period of time.

If, any of the witnesses do not appear, then the ld. Trial Court will inform the officer-in-charge/inspector-incharge of Jagaddal P.S., who would take steps for ensuring regarding the presence of the witnesses concerned. Learned Public Prosecutor conducting the case would produce the materials, exhibits and the documents on the next date so fixed for examination of the witnesses concerned. No unnecessary adjournment shall be granted to either of the parties. All stakeholder would cooperate with the Learned Trial Court for concluding the trial at the earliest.

With the aforesaid observations, CRR 542 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
