Parties are represented including the employer company represented by Mr. Majumdar, learned senior advocate.
Mr. Majumdar, learned senior advocate for the employer is instructed to handover a cheque of Rs.1,25,000/- as the part payment of the gratuity amount due and payable to the petitioner. He submits that the same is the 2nd part of the total amount of gratuity to the tune of Rs.3,32,407/-. Mr. Majumdar has further submitted that for the time being, the employer may be allowed to operate the bank account by lifting the attachment order as imposed by the
alleged contemnor and seeks accommodation, so that the employer can pay the entire gratuity amount within a short period of time to the petitioner. Heard submissions. It is found proper that employer be directed to handover a cheque of Rs.1,25,000/- immediately to the petitioner as a part payment, in addition to Rs.1,00,000/- paid earlier to the petitioner. It appears from record that from the total amount (without interest) of Rs.3,32,407/- of gratuity, a part has been thus, paid to the petitioner. Since the employer undertakes to remit the rest of the amount within a short period of time, it is directed that the alleged contemnor withdraws the attachment order as to the account of the employer in the bank, for the time being.
Let necessary steps be taken in this regard by the alleged contemnor within a period of two weeks from the date. Let the cheque be realized after lifting of attachment order by the alleged contemnor of the bank account of the petitioner. Let the alleged contemnor inform in writing to the petitioner regarding lift of attachment of the bank account of the said employer, so that the cheque may be immediately encashed.
