This is an application seeking an expeditious conclusion of trial in GR Case No. 881 of 2020 presently pending before the learned Chief Judicial Magistrate, Bidhannagar, North 24 Parganas arising out of Bidhannagar South P.S. Case No. 165 dated 12.12.2020 under Sections 354 and 506 of the Penal Code.

Affidavit service filed on behalf of the petitioner is taken on record.

Report filed on behalf of the State is also taken on record.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. FIR was lodged on 12.12.2020 and the charge sheet has been submitted on 31.12.2020. A supplementary charge sheet came to be filed on 21.05.2021. Although charges were framed on 05.01.2023, till date not a single witness has been examined. The proceeding has remained pending for no fault of the present petitioner.

Learned counsel appearing on behalf of the State submits that the State would not come in the way if a direction is passed to expedite the trial.

No prejudice will be caused to anyone if a direction is passed to conclude the trial expeditiously.

It appears that there has been some delay in conducting the trial, especially considering the fact that no witness has been examined till date although the charges were framed in the early part of the 2023.

In the view of the above and in the interest of justice, I request the learned trial court to conclude the trial in accordance with law and as expeditiously as possible, without granting any unnecessary adjournment to any of the parties and by taking appropriate measures to ensure attendance of witnesses.

With these observations and directions, the revisional application is disposed of.
