Affidavit of service filed in Court today is taken on record.

The petitioner was granted sand mining lease vide lease deed dated 31.01.2017. Due to the advent of Covidpandemic and restrictions imposed by the Government, the petitioner was unable to carry on mining operations for considerable period of time and has prayed before the concerned authority for extension of the lease. The representation submitted by the petitioner before the authority on 11.01.2022 is yet to be considered. The petitioner has prayed for a direction upon the authority to consider the representation at the earliest.

Upon consideration of the submission made by the learned counsels appearing on behalf of the parties and the material on record, the writ petition is disposed of directing the 7th respondent to consider and dispose of the representation submitted by the petitioner dated

11.01.2022 within one month from the date of communication of this order after affording reasonable opportunity of hearing to the petitioner, in accordance with law.

The decision taken by the authority shall be communiated to the petitioner within a week thereof. With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
