When the matter is called on, the Learned Advocate for the petitioner is found absent in virtual mode. The petitioner was a Bank Manager (Personal Division), lastly posted at Salkia Branch, State Bank of India. It was alleged that the petitioner had misappropriated public money on 26th November, 2008. Over the said incident, F.I.R. was lodged on 7th April, 2011 and charge-sheet was filed on 25th October, 2017 showing the petitioner as absconder. The warrant of arrest was issued accordingly by the Trial Court. However, the petitioner has not surrendered before the Trial Court as yet.

The conduct of the petitioner does not inspire us to grant the benefit under Section 438 of the Code of Criminal Procedure. Accordingly, the application under Section 438 of the Code of Criminal Procedure is dismissed.
