After hearing the parties and considering the materials on record, I find that the parameters specified in the promotion has not been fulfilled by the petitioner. Even though, in case of higher scale of pay granted to a teacher for obtaining higher qualification the last date of the examination by which the higher qualification is obtained is reckoned to be the date from the higher scale of pay is granted but considering the position of law and the specific stipulation in the advertisement that three years experience shall be counted after obtaining the bachelor's degree, such parameter is not fulfilled in the instant case.

The writ petition is, therefor, dismissed as the petitioner has not been able to fulfill the essential condition fixed for the promotion.
