Ghosh .... for the State in WPA No.2290 of 2019 In Re: WPA No.3498 of 2022 The grievance of the petitioner is that, despite having given a representation to the Assistant

Registrar, Co-operative Societies on January 15, 2019 regarding several complaints made by the petitioner, the Assistant Registrar, that is, the respondent no.4, has not taken any steps in that regard.

Learned counsel appearing for the respondent no.4, in his usual fairness, submits that although the representation dated January 15, 2019 (Annexure-P4 at page-20 of the writ petition) is not in the form of a dispute case, the Assistant Registrar is willing to take steps for inquiry subject to the order of this court. Since certain serious allegations have been levelled in his complaints by the writ petitioner, it would be desirable that the Assistant Registrar inquires into the matter in accordance with law at the earliest.

Accordingly, WPA No.3498 of 2022 is disposed of, without any order as to costs, by directing the respondent no.4 to initiate and conduct an inquiry within the contemplation of Section 100 of the Cooperatives Societies Act, 2006 on the basis of the representation, being Annexure-P4 at page-20 of the present writ petition and to dispose of the same as expeditiously as possible, preferably within two months from date, and to take appropriate steps accordingly.

In Re: WPA No. 2290 of 2019 With CAN 1588 of 2019 CAN 1588 of 2019 be treated to be on the day's list on the consent of the parties.

In view of sufficient reason having been given for the absence of representation of the petitioner on the concerned date, CAN 1588 of 2019 is allowed, thereby recalling the order dated February 06, 2019 passed in W.P. No.2290(W) of 2019 and restoring the said writ petition to its original file and number.

Liberty is given to the parties to mention the writ petition for being enlisted before the appropriate Bench having determination to take up the matter. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
