2026-03-31Hon'Ble Justice Jay Sengupta2 pages

AD 64 March 31, 2026 Ct. 28 SG CRM(A) 595 of 2026 Reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Tamluk P.S. Case No.458 of 2025 dated 09.06.2025 under Sections 3(5)/62/64/76/79/109/115(2)/117(2)/118 (1)/303(2)/324(4)/329(4)/351(2) of the BNS, 2023. And In the matter of: Sk. Mahammad Mamud @ Laden @ Mabud Ali ... petitioner Mr. Sabyasachi Mukherjee Mr. Mukesh Khanna Ms. Swastika Saha Ms. Debjani Chakraborty ... for the petitioner Mr. Anwar Hossain Mr. Santanu Deb Roy ... for the State Mr. Bhaskar Hutait ... for the de facto complainant Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. The petitioner may be granted anticipatory bail on any stringent conditions.

Learned counsel for the de facto complainant opposes the prayer for anticipatory bail and submits that there was an attempt to rape. The female victim and the other family members were seriously assaulted on vital parts of the body like head.

Learned counsel for the State opposes the prayer for anticipatory bail, relies on the statements of witnesses

including those of injured victims and the statement of the female victim recorded before the learned Magistrate and the injury reports, one of them shows assault on vital parts of the body like head requiring stitches for repair. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
