This is an application seeking an expeditious disposal of a proceeding in which a charge sheet was submitted under Sections 323, 324, 341, 354A and 506 of the Penal Code.
Let a copy of this application be served upon Ms. Manisha Sharma, learned Counsel who ordinarily appear on behalf of the State. Let her represent the State. Her engagement may be regularised by the competent authority of the State in due course. Learned Counsel appearing on behalf of the petitioner submits as follows. The petitioner is the de facto complainant in this case. She had lodged the First Information Report on 21.12.2020. A charge sheet was submitted in January, 2021. Cognizance of the alleged offences was taken in February, 2021. However, after that, dates were fixed for service report for the process issued upon the accused. The matter has remained pending for no fault on the part of the present petitioner. Learned Counsel appearing on behalf of the State submits that there is no inordinate delay in conducting the proceeding. Due to the huge work load of cases before the learned Trial Courts, some persons are suffering custody trial in respect of the charges under the NDPS Act, since 2018.
I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition.
In view of the above, I do not find that an inordinate delay has been occasioned in this case.
However, it is expected that the learned Magistrate would conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties. With the above observations, the revisional application is disposed of.
