The learned Advocate appearing for the appellant submits that due to bona fide mistake the instant appeal has been filed before this Court, though the same is not maintainable. He prays for withdrawal of the instant appeal to take appropriate steps.

In view of the above, the appeal is dismissed as withdrawn.

However, the dismissal of the appeal shall not prevent the appellant to exhaust its remedy available under the law.
