The writ petition was preferred in respect of a 16.07.2025 Court No. 35 M/L. No.776 Rakib vehicle which was financed by the respondent no.4. There were no representations or point of grievance by way of written information addressed to the police authorities. Petitioner's only prayer was not to disturb the petitioner's lorry business or not to seize the lorry bearing registration number WB 65D9240.

Having considered that prima facie the genesis of the case arise out of a hire purchase agreement, until and unless there are excesses being involved, there is hardly any scope for the police authorities to interfere in such dispute. Having regard to the same, I am of the view that no interference is called for.

As none appears on behalf of the State, Ms. Sonal Sinha with Ms. Shabnam Farooqi, learned advocate who ordinarily appears on behalf of the State is directed to represent the State. Her appearance may be regularized by the concerned authorities.

Learned advocate appearing for the respondent no.4 is present and submits that the copy of the application has not been served upon them also. Regard being had to the period which has lapsed, petitioner would be at liberty to file a representation at least before the jurisdictional police authorities in respect of the grievance.

With the aforesaid observations WPA 3725 of 2024 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
