Learned advocate appearing on behalf of the petitioner/appellant submitted that this special leave petition has been filed with a prayer for filing appeal against the order dated 16th December, 2023 passed by the learned Metropolitan Magistrate, 3rd Court, Calcutta in connection with Complaint Case No. CS/49643 of 2021, dismissing the case invoking Section 256(1) of the Code of Criminal Procedure on the ground of absence of the complainant.

Learned advocate on behalf of the petitioner/appellant has drawn my attention regarding misplace of records and knowledge of the complainant.

Having gone through the records as well as having heard the learned advocate appearing on behalf of the petitioner/appellant, leave is granted.

The petitioner/appellant is at liberty to prefer an appeal within the statutory period.

With the aforesaid observation, CRMSPL 11 of 2024 stands disposed of.
