The allegation in this petition is that there is a 12ft. wide road existing at Plot No.496, J.L. No.101, Mouza - Zhikra which is being used by the local people for last 50 years but now the respondent no.8 with the help of some anti social elements is trying to close the said road.
Learned counsel for the State has pointed out that the respondent no.7 i.e. Prodhan, Hadipur Zhikra No.1 Gram Panchayat is the competent authority to look into this issue.
Hence, we dispose of the present petition permitting the petitioner himself or through his authorised agent to file the appropriate representation before the respondent no.7 within a period of two weeks
from today and on receipt of the said representation the respondent no.7 will give due opportunity of hearing to all the concerned parties and take a decision in accordance with law as expeditiously as possible preferably within a period of three months from the date of receipt of a copy of the representation.
Till the decision is taken by respondent no.7, the road in question will not be closed.
The petition is, accordingly, disposed of.
