On hearing the learned counsel for the petitioner and the learned counsel appearing for the State of West Bengal, it appears that the petitioner's representation dated 19th November, 2018 has not been considered by the respondent/Municipality till date.

Considering the materials on record which relates to erroneous assessment the respondent/Municipality being the respondents no. 1 to 3 are directed to dispose of the representation dated 19th November, 2018 filed by the petitioner, a copy of which may be handed over to them (BMC) in case they are unable to trace out the

representation and the said representation be disposed of within a period of 60 days from the date of handing over the said copy of the representation along with a copy of this order. The said consideration shall be on hearing all the stakeholders and shall be disposed of by passing a reasoned order in accordance with law. The writ petition stands disposed of.

Pending applications, if any, stands disposed of. Interim order, if any, stands vacated.

Urgent Photostat certified copy of this order, if applied for, be given to the parties, upon usual undertakings.
