India Green Realty Private Limited and others Mr. Avijit Ghoshal .. for the petitioner Since the petitioner seeks expeditious disposal of C.S./7577 of 2017 pending before the learned Metropolitan Magistrate, 6th Court at Calcutta presently redesignated as learned Judicial Magistrate, 6th Court at Calcutta, the matter may be taken up for consideration without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case.

This court is informed that the accused was examined under Section 313 of the Code of Criminal Procedure on 17th September, 2018 and since then several dates have been fixed for hearing argument. Petitions under Section 311 of the Code of Criminal Procedure were filed by the accused before the learned trial court and despite the learned trial court allowing the applications and fixing dates for re-cross examination of PW1, the accused has failed to re-cross examine the witness till date.

In view of the fact that the case is at a very mature stage, the learned trial court is directed to complete the re-cross examination of the witness (PW1) on the next date of hearing fixed before him and if the same is not possible due to unforeseen circumstances, within two weeks thereafter. The learned trial court shall take the

proceeding to its logical conclusion within three months from the date of conclusion of re-cross examination of PW1 without granting any unnecessary adjournment to either of the parties, in accordance with law.

CRR 766 of 2025 is accordingly disposed of.
