28.07.2021 Ct.32 Tanmoy C.R.M. 1661 of 2021 In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure filed on 09/02/2021 in connection with Raninagar Police Station Case No. 125 of dated 24/02/2020 under Sections 448/325/307/34/302 of the Indian Penal Code.

The allegation against the petitioners is that they caused grievous bodily harm and attempted to murder the victim who, ultimately, succumbed to the injury inflicted on him.

Accordingly, Section 302 of the Indian Penal Code was added subsequently.

We have seen the material in the Case Diary including the medical reports. The injury was serious which caused the death of the victim. The victim named the petitioner nos.2 and 3 and the names of the petitioner nos. 2 and 3 also appear in the medical records as having inflicted the injury. The name of the petitioner no.1 appears in the First Information Report. Having regard to the nature and gravity of the offence and the degree of the complicity of the petitioners in the commission of the offence, we are not inclined to extend the privilege of anticipatory bail to the petitioners.

Accordingly, the application for anticipatory bail being C.R.M. 1661 of 2021 is dismissed.
